TERMS & CONDITIONS

1. Overview

a. All Rental Agreements/Hire Agreements with Optimum Motorhome Rental are subject to this set of Terms and Conditions. 

b. Definitions

i. ‘The Client’ or ‘Customer’ or ‘Driver’ this is the person who is the lead party in the agreement making payment and the main driver of the Vehicle. This must be the same person. 

ii. ‘This Agreement’ means the Rental Agreement, the Insurance Motor Rental Agreement and these Terms and Conditions. In the event of conflict between these terms and conditions and any other terms and conditions, the provisions of these Terms and Conditions apply. 

iii. ‘Booking’ the confirmed reservation of a motorhome hire and includes the payment of the booking deposit and / or full balance for the rental. 

iv. ‘Booking Deposit’ means the monetary amount required to confirm the motorhome booking. 

v. ‘Rental Period’ Means the hire period as stated on the Rental Agreement or any agreed variation thereof and any additional period during which the Vehicle is in the customer’s possession or control. 

vi. ‘Vehicle’ Means the vehicle as stated on the Rental Agreement and includes tyres, tools, accessories, internal equipment and any other special equipment, documents related to the Vehicle and any replacement or substitute Vehicle which may be provided at the discretion of Optimum Motorhome Rental. 

c. By signing the Rental Agreement or Hire Agreement the client declares to have read, understood and agreed to the following set of terms and conditions. The client is therefore legally agreeing to abide by them. 

2. Insurance & Requirements

a. All payments made to Optimum Motorhome Rental must be through bank transfer, so the funds are traceable. 

b. Drivers can not be under the age of 23 or over the age of 79. 

c. Drivers must have at least 2 years of driving experience. 

d. A Photo of both the front and back of all driving licenses must be supplied, (address & ID must be up to date) 

e. A DVLA Licence check number must be supplied for all drivers within 21 days of the rental period 

f. Two of the following proofs of address must be supplied for each driver:

i. An annual council tax bill will be accepted. All other documents must be dated within 90 days of the hire date. The address & name on your licence must match both documents.

g. A minimum Security Deposit of £1,000 must be taken from the client. 

h. No more than 6 points on licence (‘SP’, ‘TS’,’CU’ only, all other codes will not be accepted for insurance) 

i. Signed Rental Agreement 

3. Bookings & Payments

a. A booking request does not guarantee a booking, all bookings will be confirmed back in writing/email and only binding once a deposit of £50 per day or £250, whichever is the highest has been received and confirmed by Optimum Motorhome Rental. 

b. Full payment will be due four weeks prior to rental starting, after this the booking will be considered cancelled and subject to the cancellation charges.  

c. Rentals booked within four weeks of the rental start date must be paid in full. 

d. The rental rates quoted includes vehicle insurance as standard for named driver, additional drivers can be added at an additional cost. 

e. Minimum rental periods are 5 days depending on availability. Optimum Motorhome Rental reserves the right to change this for any reason. 

f. Optimum Motorhome Rental reserve the right to amend any accidental errors in quotations. 

g. Payment must be made to Optimum Motorhome Rental via bank transfer. 

4. Cancellations

a. Any deposit taken is non-refundable. Optimum Motorhome Rental strongly recommend that travel insurance is taken out at the time of booking to cover any unexpected occurrences preventing travel.   

b. Less than 4 weeks to the date of departure 100% of the hire cost is non-refundable. 

c. Should a customer not present themselves to collect a vehicle and not contact Optimum Motorhome Rental on or before the collection date then the hire will be cancelled (by 16:00 hours on the collection date) and the rental charge is then forfeited by the customer. 

d. The above charges apply to all hires and no exceptions can be made for any circumstance. 

e. In the unfortunate circumstance that events beyond Optimum Motorhome Rental’s control mean that a motorhome is not available as agreed, Optimum Motorhome Rental will, where possible, offer you an alternative motorhome, a rearrangement of dates, or will provide a full refund of all monies you have paid for your booking. The liability of Optimum Motorhome Rental will be limited to the return of any monies paid for the hire of the Vehicle only. Optimum Motorhome Rental strongly advises that the relevant insurance is taken out at the time of booking to cover any lost pre-booked travel or campsite costs in the circumstance a booking is cancelled beyond the hirer’s control. 

5. Collection & Return

a. Collection time will be between 9am and 6pm and the client should advise pick up time so the Vehicle can be prepared.  

b. The client should allow for 30 to 60 minutes for the hand over process at both collection and return. 

c. The Vehicle shall be return no later than 6pm on the return date. Late returns will be subject to charges if prior consent has not been given. 

d. All drivers must be present for both collection and return. 

e. As part of the process a video with be taken showing the condition of the Vehicle and the drivers before the rental proceeds. This will be used as evidence of any damages or condition of the Vehicle upon return. 

f. The Vehicle must be return in a clean and tidy manner, undamaged, with a full tank of fuel, empty wastewater and clean/empty toilet cassette. 

g. Please note the facilities required for the above are not available at the collection or return point of the Vehicle. 

h. The Vehicle must be empty of all personal belongings; Optimum Motorhome Rental cannot be held responsible for any lost property or items left in the Vehicle. 

6. Client Responsibility

a. You must look after the Vehicle and the keys to the Vehicle. 

b. You must always lock the Vehicle when you are not using it and use any security device fitted to or supplied with the Vehicle. 

c. You must always protect the Vehicle against bad weather which can cause damage. 

d. You must make sure that you use the correct fuel. 

e. You must not tamper with the mechanics of the Vehicle at any time. 

f. You are responsible for any damage to the Vehicle caused by hitting low level objects, such as bridges or low branches. 

g. You must not sell, rent or dispose of the Vehicle or any of its parts. You must not give anyone any legal rights over the Vehicle. 

h. You must not let anyone work on the Vehicle without the permission of Optimum Motorhome Rental. 

i. You must notify Optimum Motorhome Rental as soon as you become aware of a fault in the Vehicle. 

j. You must bring the Vehicle back to the place agreed, at the time agreed and remain responsible for the Vehicle until this time. The Optimum Motorhome Rental representative must see the Vehicle to check that it is in good condition.

k. You are responsible for the vehicle at all times during the hire period including any damage to could occur when parked up/camping. This is particularly important when attending festivals and other high foot traffic events.

 

7. Usage

a. The Vehicle must only be driven by the hirer and/or any other driver named on the Rental Agreement. 

b. Not use the Vehicle for hire or reward. 

c. Not use the Vehicle for any illegal purpose. 

d. Not use the Vehicle for racing, pace keeping, testing the Vehicle’s reliability and speed or teaching someone to drive. 

e. Not use the Vehicle while under the influence of alcohol or drugs. 

f. Not allow smoking in the Vehicle under any circumstance (Including vaping). 

g. Not use the Vehicle to travel to unauthorised festivals or sports events. 

h. Not allow animals into the motorhome without prior consent. 

i. Not drive the Vehicle outside England, Scotland and Wales, unless the European travel pack has been added to the extras. 

j. Not use the Vehicle to propel or tow any other motorhome or trailer. 

k. Not overload the Vehicle. 

l. Not carry more passengers than the seating capacity of the vehicle or allow the Vehicle to be overloaded. 

m. Ensure that when the Vehicle is in motion, passengers are seated in the designated seats wearing the seat belt provided or necessary child restraints. 

n. Ensure when the Vehicle is in motion that the gas is turned off and any items not bolted down are made secure. 

o. Ensure when the Vehicle is in motion all windows are closed and secure properly. 

p. All Vehicles may only be driven on sealed / bitumen roads 

q. Not make any alterations or additions to the Vehicle. 

8. Extras

a. Additional drivers – £50 per hire per driver. 

b. Off season mileage limit of 150 miles per day, any additional mileage charged at 45 pence per mile

9. Charges

a. Fuel tank not fullCost of fuel + £50 

b. Waste water tank not empty – £50 

c. Toilet cassette not empty/clean – £150 

d. Late returns – £100/hour 

e. Any damage to the exterior or interior of the Vehicle – subject to quote + down time rate of £100 per day (This is not capped at the Security Deposit and Optimum Motorhome Rental would request additional monies if due) 

f. Cleanliness – Vehicle should be return in the same condition it was collected both interior and exterior, £150 valeting fee may be charged. 

g. Smoking/Vaping – £150 

h. Fine & Penalties – The client/driver is responsible for any fines or charges while in the rental period. Including but not limited to parking, traffic or other offences, congestion charges, (including any costs which arise if the Vehicle is clamped). You must pay the appropriate authority any fines and costs if and when the authority demands this payment. If you do not, you will be responsible to pay any costs and reasonable administration charges which arise when Optimum Motorhome Rental deal with or act as intermediaries in these matters. 

i. The insurance excess should there be damage involving third party property or the theft of the Vehicle applies in respect of each claim, not hire. 

j. All government fees and duties 

k. Demurrage; the nightly rental rate for the period the Vehicle is off fleet; for example, accident repairs 

l. Any additional costs over and above the Security Deposit value should damages exceed the Security Deposit value 

m. The cost to recover a Vehicle 

n. In the case of gross negligence Demurrage reserves the right to recover full costs in order to return the motorhome to the state in which it was handed over. 

10. Security Deposit

a. There is a refundable £1,000.00 Security Deposit payable by bank transfer. This must come from the main driver’s bank. Optimum Motorhome Rental reserves the right to increase the Security Deposit in certain circumstances or for specific events e.g., World Cup events, Festivals, customers travelling with pets, for any other hire where the motorhome is carrying 4 or more adults to £1500.00. 

b. On collection of the Vehicle, you agree to pay the Security Deposit. You irrevocably authorise Optimum Motorhome Rental to deduct from the Security Deposit any amounts due by you to Optimum Motorhome Rental arising out of this Agreement. The Security Deposit will be refunded within 7 days of the Vehicle being returned to the return location set out in the Rental Agreement. 

c. Should any damages or costs exceed the Security Deposit the customer will be responsible to settle all additional costs over and above the Security Deposit value within 14 days of being notified of the cost. 

d. Note: The client should be aware that the Security Deposit will be used to fund any loss or damage whatsoever relating to any loaned equipment, or damage to fixtures and fittings and windows, bedding or upholstery. If cleaning or valeting beyond regular use is required, if refuelling costs are incurred by Optimum Motorhome Rental, or if there is damage caused to the Vehicle through negligence, additional charges will be incurred. Should any damages exceed the Security Deposit held, the customer will be liable for the total cost and the difference will need to be settled within 14 days of returning the Vehicle. 

11. Accidents

a. No responsibility can be accepted by Optimum Motorhome Rental for any loss or damage or expense, which occurs as a result of any accident. In the event of an accident the hirer must: 

i. Notify Optimum Motorhome Rental within 24hrs of the event occurring 

ii. Obtain the names and addresses of third parties and any witnesses and report the event to the nearest police station 

iii. Complete an accident claim form as supplied 

iv. If the accident occurs in Europe, then in addition you must complete the European accident report form as supplied 

v. Not make any admission of liability to other parties, settlement offer or other like offer 

vi. Assist Optimum Motorhome Rental in handling any claim arising from any event, including providing all relevant information and attending court to give evidence 

vii. Acknowledge that the excess or other amount due by you in respect of any damage arising from an accident, loss or damage is payable at the time of reporting the event and not at the completion of the rental period, regardless of which party is at fault 

viii. No Security Deposit or insurance excess will be refunded until any claim is settled 

12. Maintenance

a. You shall take all reasonable steps to properly maintain the Vehicle, including checking oil, coolant and AdBlue levels, tyre pressures and batteries. 

b. You are aware that the Vehicle will be supplied with a full tank of fuel, and AdBlue and that it is the client’s responsibility to replenish these throughout the rental period and return these all full otherwise charges will apply. Optimum Motorhome Rental will not be held responsible should you run out of any of these during the rental period 

c. You acknowledge that Optimum Motorhome Rental will reimburse you for expenditure up to £50.00 reasonably incurred in rectifying any mechanical failure to the drive train and engine of the Vehicle (not including the water system, refrigerator, heating, audio and DVD equipment, provided that: 

i. You produce relevant receipts: and 

ii. You have received the prior consent from Optimum Motorhome Rental 

iii. The damage is not due to the client’s fault or breach of the rental agreement or terms and conditions. 

d. Subject to the terms of this agreement, you will pay for the cost of repairing or replacing tyres damaged during the rental period. Optimum Motorhome Rental will reimburse you for expenditure reasonably incurred if: 

i. The tyre is defective and is returned by you to Optimum Motorhome Rental for inspection; and 

ii. You produce relevant receipts; and 

iii. The manufacturer accepts liability under his warranty 

e. You will be liable for any costs associated with allowing the engine oil, coolants or AdBlue to run empty and cause damage to the Vehicle’s engine 

f. You will be liable for any costs associated with the incorrect use of fuel. 

13. Breakdowns

a. No responsibility can be accepted by Optimum Motorhome Rental for any loss, damage or expense, which occurs as a result of any defect or breakdown. Optimum Motorhome Rental will not be responsible for hotel costs or any other expenses subsequent to a breakdown. The hirer will indemnify Optimum Motorhome Rental from any liability.  

b. If the Vehicle does breakdown you should take the following steps: 

i. Contact the breakdown service using the number provided, quoting the registration of the Vehicle. 

ii. Contact Optimum Motorhome Rental and provide details of the breakdown. 

iii. If the Vehicle is taken to a mechanic, Optimum Motorhome Rental must be contacted prior to any work being undertaken on the Vehicle. 

iv. In the unlikely event that the client needs to pay for work to be undertaken, Optimum Motorhome Rental must be provided with a detailed receipt before the client can be reimbursed. 

14. Data Protection & Privacy Policy

a. Your personal data and information that you have provided to Optimum Motorhome Rental will be processed for the following purposes and in accordance with this Privacy Policy

b. To fulfil this contract/ agreement placed with us, including but not limited to motorhome hire and production of the Rental Agreement. Your personal data including copies of all identification documents provided and all data entered in the Rental Agreement will be retained for 7 years for the purpose of, but not limited to the defence of any legal claim(s) 

i. To fulfil our legal requirements as a vehicle rental company 

c. We will not transfer your personal data to any third party outside the Optimum Motorhome Rental and its agents, unless: 

i. It is to book a third-party service for you including ferry crossing and taxi transfers 

ii. It is to enrol you in a third-party membership including caravan club, camping and caravanning club and English heritage memberships 

iii. It is for on road vehicle assistance for example vehicle recovery/breakdown providers and repair workshops 

iv. It is to our insurer and their agents 

v. It is to the police, local authorities, councils or DVLA if we suspect or are notified that a road traffic offence/ contravention has occurred 

vi. It is to local authorities, councils and private parking companies if we suspect or are notified that you breached private parking terms and conditions, dart and congestion charges 

vii. To insurance companies if we suspect or are notified of an incident with a third party 

viii. It is to the police, DVLA and Customs and Port authorities if we suspect or are alerted to criminal activity 

ix. Our bank or merchant provider in line with transactional processing 

x. You are in breach of our agreement in which case we may notify the BVRLA’s RISC database, police, our solicitors, debt collection agencies, credit reference agencies and any other relevant organizations 

xi. The third party is our subcontractor or a member of our companies, who is processing personal data on our behalf securely and in accordance with our instructions 

xii. It is between software systems that we use for the purpose of our business as a vehicle rental company. 

xiii. It is for feedback on our products and services provided 

xiv. It is otherwise authorised under the Data Protection Act 

d. By entering into this agreement, you agree that we can process and store your personal information in connection with this agreement including data collected from the Vehicle which may include your location(s) from our vehicle tracking system and also diagnostics (telematics). We may use your information to analyse statistics, for market research, credit control and to protect our assets. 

e. You agree that if you break the terms of this agreement, we can pass your personal information to any relevant organisation. We can also give this information to the British Vehicle Rental and Leasing Association (BVRLA), which can share your personal information with its members to prevent crime and protect their assets, as allowed under the Data Protection Act 1998. 

f. We agree to keep all personal information in a secure environment and will comply with the Data Protection Act 1998 and our own privacy policy and any other applicable date protection legislation currently in force. 

g. Cookies are used on our website.  You may refuse to accept cookies by activating the setting on your browser; however, by selecting this setting you may be unable to access certain parts of our site. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you access to our site. 

15. Governing Law

a. This agreement is governed by the laws of England and Wales. Any dispute may be settled in the courts of that country. 

16. Force Majure

a. Optimum Motorhome Rental will make every effort to ensure that the reserved Vehicle is available for you at the correct time. If, due to circumstances beyond our control, this is not possible and if an alternative or acceptable Vehicle is not available our liability is limited to the refunds of all monies paid by you 

17. Entire Agreement

a. This Agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this agreement. Optimum Motorhome Rental reserves the right to add or amend the specifications and rental charges without prior notice. This agreement does not affect your statuary rights under civil law.
